LEGAL TEST
Why do a
legal paternity test?
- When you do a peace of
mind (home) paternity test, each donor takes their
sample themselves at home, thereby allowing no
means to confirm that the sample truly originates
from the stipulated donor. When you participate
in a legal paternity test, each donor must attend
a proper collection with a qualified doctor to
have a buccal swab (mouth swab) taken. Also, photo
identification and other verification measures
are required to confirm that the samples have
come from the stipulated donor.
- DNA Solutions Pty. Ltd.
is an ISO17025 accredited laboratory, conducting
legal parentage testing that is accepted in a
court of law and government departments.
- It is not possible to
upgrade from a peace of mind test to a legal test,
so if you will ultimately require a legal test,
it would be more economical to do a legal test
initially.
Legal parentage tests adhere
strictly to the Family Law Regulations and ISO standards,
but our friendly customer service staff are more
than happy to help guide you through this process
step-by-step. Please do not hesitate to contact
us at any stage during testing to ask questions,
obtain an update, etc. Below you will see the process
for a legal paternity test outlined so that you
can understand what will be involved (although if
you prefer to discuss it with us instead of reading
below, please call!).
- It is strongly advised
to include a mother in a legal paternity test,
but it can be done with only father and child.

- Once you have decided
to do a legal paternity test (either on your own
or through guidance from legal council or DNA
Solutions Pty. Ltd. staff), contact our office
on 1800 000 362. We will arrange to send you the
paperwork that you will need; we can send this
via normal post, email, or fax, or you may download
the paperwork yourself by clicking on the button
below.

- Also in this initial phone
call we will organise for your collection. We
have collection points established around Australia,
so we will take your post code and find the nearest
collection point to you. If you prefer to go to
your own General Practitioner (GP), that is fine
as well and please be prepared to provide us with
their name, address, and telephone number when
you call.
- Once we have agreed upon
a location for your collection, we will organise
the collection with the collection center or your
GP and send your collection kit via Express Post.
After approximately 3 business days, you can contact
the collection center and identify yourself by
name and set up an appointment to have your collection
done, as they should have your collection kit
by that point (if not, please notify us on 1 800
000 362). It is very important that you arrange
your appointment for collection such that you
will have time to go to a Justice of the Peace
prior to your collection (discussed in more detail
three points below).
- We understand that in
a legal paternity case, the alleged father, mother,
and child may not all be communicating efficiently
with one another. We can work with each adult
party individually to organise the paperwork and
collections if that is what you prefer, or one
adult can make the arrangements for all parties
to be involved.
- Once you have your paperwork
(or while waiting for it to arrive via post) you
need to organise two (2) passport sized photos
of each donor. These do not need to be actual
passport photos, but must be passport sized, full
frontal original colour photos with none of the
facial features obscured.
- On the day of your collection,
but prior to your collection, go to a Justice
of the Peace (JP) and have your Affidavit witnessed.

- A GP is NOT necessarily
a Justice of the Peace
- A police officer
with a rank of Sergeant or above is a Justice
of the Peace
- A solicitor/lawyer
is a Justice of the Peace

- Payment can be made via
credit card (details can be entered on the paperwork
or you can call us to give us these details) bank
cheque, personal cheque or money order. Payment
details should be submitted along with your paperwork
at the time of your collection.
- Take all of your paperwork
to your collection with you, consisting of the
Affidavit, Collection Form, and the Parentage
Testing Information Sheet (including payment details).
The collector will return all paperwork (including
payment details) along with the samples directly
to DNA Solutions Pty. Ltd. via Express Post.
- Upon receiving your samples
and paperwork directly from the collector, our
Sample Reception staff will review the paperwork
and samples against our Family Law Regulations
and ISO guidelines. If there are any issues with
the paperwork or samples, we will contact you
as soon as possible.
- Once we have received
all the samples, paperwork, and payment for a
test and they have been approved, we will begin
processing your test. Normal testing time is ten
(10) business days from the day that we approve
all the samples and paperwork.
- Upon completion of testing,
an analyst will call each adult donor to issue
the results and original hard copies of reports
will be mailed to each adult party involved in
the testing. The report will include statistics
calculated for your particular case if the result
is a match and should exceed 99.9%. If the result
is a mismatch, it is 100% that it is a mismatch
and the statistics are therefore not calculated
nor reported.
